Who Participates In Arbitration?
INDIVIDUALS, BUSINESSES AND ORGANISATIONS
Arbitration can be the right solution for anyone with a dispute – no matter how big or small. At SHAW Arbitration, our clients range from individuals and families with personal disputes, to community organisations, to corporations with commercial disputes who all want a quicker, more affordable form of dispute resolution in a safe and fair environment that offers long-lasting outcomes. Arbitration is the preferred alternative for preserving relationships and reputation, as both can get tarnished during open and lengthy court proceedings.
At SHAW Arbitration, our Arbitrators have legal qualifications and experience. They know the law and are experts in their chosen jurisdiction. They are passionate about resolving the dispute for you with a legally binding decision where parties can’t agree and would prefer someone else to decide.
SHAW Arbitration ensures there is procedural fairness and natural justice every step of the way by an independent and professional arbitrator who holds a planning meeting before the hearing. The award with reasons is published by the Arbitrator within 28 days of the hearing.
At SHAW Arbitration, we encourage sensible legal representation to assist with the Arbitration. This may include a solicitor and barrister. This helps you comfortably ensure that all the necessary evidence is before the Arbitrator upon which they are confidently able to decide your case. The lawyers have an important role to play in Arbitration from start to finish. They advise you about what matters to refer to the Arbitrator for a decision and upon what evidence it will be necessary and important to obtain as well as how the hearing should be conducted. They will advise you about the range of potential outcomes and risks. During the Arbitration, they can make the submissions on your behalf and lead the evidence for you and cross examine opposing evidence where required. When the Award is handed down, the lawyers can legally register the Award and attend to the filing of the final and binding decision made by the Arbitrator.
Alison Shaw of SHAW Mediation successfully mediated a contract and building works dispute for one of our clients. I found the mediation to be useful in requiring the disputing parties to be in one place at one time, allowing each side to express their position (and even vent their frustrations) whilst being kept in line by an experienced mediator. It was by no means certain to me beforehand that the matter would resolve at the mediation, but Alison’s guidance and systematic approach facilitated a commercial settlement. I am confident the parties would not have reached a better outcome if they had gone to court. I rate highly the mediation process used by Alison Shaw in this matter, and would recommend her to other clients considering mediation in the future.Matthew Hawke
