SHAW Arbitration ensures there is procedural fairness and natural justice every step of the way by an independent and professional arbitrator who holds a planning meeting before the hearing. The award with reasons is published by the Arbitrator within 28 days of the hearing.
At SHAW Arbitration, we encourage sensible legal representation to assist with the Arbitration. This may include a solicitor and barrister. This helps you comfortably ensure that all the necessary evidence is before the Arbitrator upon which they are confidently able to decide your case. The lawyers have an important role to play in Arbitration from start to finish. They advise you about what matters to refer to the Arbitrator for a decision and upon what evidence it will be necessary and important to obtain as well as how the hearing should be conducted. They will advise you about the range of potential outcomes and risks. During the Arbitration, they can make the submissions on your behalf and lead the evidence for you and cross examine opposing evidence where required. When the Award is handed down, the lawyers can legally register the Award and attend to the filing of the final and binding decision made by the Arbitrator.
Alison Shaw of SHAW Mediation successfully mediated a contract and building works dispute for one of our clients.
